5a.  Public Hearing: Ordinance 00-21 – Enclosed in your packet as Attachment #1 is a copy of proposed Ordinance 00-21 with various revisions that have been made in a process to strengthen and clarify the Town’s existing Part 9, Chapter 5 (Sedimentation and Erosion Control).  The first page of the attachment is a summary sheet that explains each of the changes that are marked in subsequent pages.

            The Town of Holly Springs began administering its own Soil Erosion and Sedimentation Program on Nov. 1, 2000.  In order to implement an effective program, the Town needs a clear, strong ordinance to enforce.  To achieve this goal, the proposed amendments to the Soil Erosion and Sedimentation Control, Stream and Wetland Protection Ordinance are necessary for several reasons:

            First, several of the changes were made to clarify and strengthen the existing ordinance.

            In addition, other changes are were necessary to comply with amendments to the State Sedimentation Control Rules (15A NCAC Chapter 4).  Staff coordinated these proposed ordinance amendments with Mr. Rick Bailey with the Wake Soil and Water Conservation District and Mr. John Holley with the N.C. Division of Land Quality, Raleigh Regional Office.  Comments received from both parties were addressed and incorporated into the proposed ordinance.

            Finally, an entire section on timbering plan requirements was added to control clear-cutting on land intended to be developed in the near future.  Staff coordinated the proposed timbering section with mr. Bob Slocum, executive vice president of the N.C. Forestry Association.  Mr. Slocum made several recommendations to the Town that were incorporated into the proposed amendments.  Mr. Slocum has worked with other municipalities (e.g. Apex) to help institute similar ordinance requirements.

            In addition to the inclusion of the aforementioned parties in the development of these proposed revisions, Engineering staff also solicited feedback from other Town departments and from the development community.

            The summary sheet details what changes were made and why (words in bold at the end of each change).  The following pages are the original ordinance with all revisions highlighted.

            Action Requested: Hold public hearing.  Action to be requested under New Business.

 

5b.  Public Hearing: Ordinance 00-22 – Enclosed in your packet as Attachment #2 is a proposed ordinance to amend the existing Part 9, Chapter 6 of the Town Code (Flood Damage Prevention).

            The Engineering Department receives numerous complaints concerning flooding in residential lots and some non-residential properties during large rainfall events.  In order to more pro-actively address these problems in the future and to reduce the impacts of flooding in Holly Springs, the Engineering Department is proposing some amendments to the existing Flood Damage Prevention ordinance.

            The proposed changes prohibit residential construction in the flood plain and place stricter requirements for residential construction in close proximity to the flood plain.  These proposed amendments are bringing the ordinance into alignment with those of several adjacent municipalities.

            After examining the proposed ordinance, the Town Attorney made several suggestions that will change some of the original ordinance wording and that will also create additional recommended modifications.  For this reason, staff recommends holding a public hearing on the attached modifications, then continuing the public hearing so that staff and the Town Attorney may consider further modifications.

            Action Requested: Hold public hearing and continue public hearing to resume at first meeting in December.

 

6a.  Ordinance 00-21 – Staff recommends adoption of proposed Ordinance 00-21 to establish an amended Sedimentation and Erosion Control ordinance for the Town that addresses stream and wetlands protection and timbering.

 

6b.  Unified Development Ordinance Committee – The Department of Planning & Zoning has issued a Request for Proposals to nearly 50 consultants nation-wide to develop a Unified Development Ordinance for the Town.  A selection committee consisting of 4 Staff members, the chair persons of the Planning Board, Board of Adjustment, and Commercial Growth Corridor Committee, and a Town Board of Commissioners representative is being organized.  This committee will review the proposals that are submitted, conduct interviews with the finalists, and select the consultant.  This same selection committee will be retained throughout the process to work with the consultants in the writing of the new ordinances and reviewing drafts.

            This selection committee will meet during the day, if possible, or as soon after 5 p.m. on a workday as possible.  The exact meeting time and day will be determined once the membership is set.

            Attachment #3 in your packet is a copy of the RFP.

            Action Requested: Select one member of the Town Board to sit on the consultant selection committee and to work with the selected consultant in the writing of new ordinances.

 

6c.  Town Board Meeting Schedule – Looking into the not-too-distant future, it appears that an adjustment in the Town Board’s regular meeting schedule may be helpful in order to maintain an effective flow of Town business during December and January.

            Two board members and the Town Manager will not be able to attend the Dec. 5 meeting as they will be leaving that afternoon for the National League of Cities Congress in Boston.  A quorum (4) of the Board would still be possible on Dec. 5; however, one unexpected absence would prevent a quorum from being established.  Monday, Dec. 4 is an option, as the Commercial Growth Corridor Committee can meet in the conference room.  Otherwise, a meeting date for the next week could be designated, except for Tuesday, Dec. 14 when the Board of Adjustment will need the Board Room.

            Looking forward to January... the last work week of December is Dec. 25-Dec. 29.  Town Hall will be closed Dec. 25 and 26, leaving a short remaining work week that may be further handicapped by holiday staff shortages.  The compilation of agenda packets in any complete or efficient form for the Jan. 2 regular meeting may be difficult.

            For this reason, it might be best to reschedule the Jan. 2 meeting to the week of Jan. 8.

            Action Requested: At the Board’s discretion.

 

7.  Weekend Directional Signs – When the new Weekend Directional Sign Ordinance was adopted in July 2000, the Town Board requested that a status report on the permitting and enforcement of the Ordinance be presented in November.  Enclosed in your packet as Attachment 4 is the report.  Discussion of the report will be held during the meeting.

 

8a.  Resolution 00-R-32 – Enclosed in your packet as Attachment #5 is proposed Resolution 00-R-32 authorizing the release of the State of North Carolina economic development funds to the Triangle J Council of Governments.  Twice each year, the State sets aside economic development funds for regional governing councils; the funds are released on a per capita basis at the request of each member municipality.  If the Holly Springs share of this fund is $531.30.  If the Town does not request the release of these funds through adoption of the enclosed resolution, the Holly Springs portion would revert to the State’s General Fund.

            Action Requested: Adoption of Resolution 00-R-32.

 

8b.  Minutes – Minutes of the Board’s regular meetings held on Oct. 17 and Nov. 7 are enclosed as Attachment #6 for your review.

A reminder of the Wake County Mayors Association Christmas party on Dec. 13 at the Capital City Club in Raleigh.  Please RSVP to Joni as soon as possible if you have not already done so.  Spouses are welcomed to attend.

 

At agenda packet deadlines on Friday, there had been no response yet to the ad in the newspaper regarding the Regional Appearance Commission; however, the newspaper has only been out for one day.

 

Town Hall will be closed Thursday and Friday for Thanksgiving.

 

The annual Holly Days parade will be Saturday, Dec. 9 through downtown.  Parking lot concession stands will open at 10 a.m.  Parade line-up on Oak Hall Drive and the Food Lion parking lot begins at 10 a.m.  The parade will step off at 11 a.m. and end around noon at Town Hall.  Music and concession stands will continue until 1 p.m.

            Residents and businesses of Raleigh Street, Oak Hall Shopping Center and Main Street and residents of the Oak Hall, Windward Pointe and Remington subdivisions will be notified next week by letter of the traffic patterns that may effect them.

            Commissioners and their families are instructed (I mean, inVITED) to appear in the parade as passengers on the Open Sled float for Holly Springs Elected Officials.  The float will be located on Oak Hall Drive, probably the first float in the line-up.  You won’t be able to miss it.... it has a big horse on it.  You may park in the Food Lion parking lot (if you need a ride back after the parade, let me know).
